In this paper, we want to link questions arising from taking appropriate technical and organizational measures with considering the chances and limitations of both, personal and anonymized data processing and the potential added value of personal and anonymized data exchange within a smart city context. We demonstrate the link through a legal analysis and 30 structured interviews with smart city participants.

Smartphones und Tablets, in den privaten und beruflichen Alltag stellt die informationelle Privatsphäre von Nutzern einen hochgradig relevanten Untersuchungsgegenstand für Wissenschaft und Praxis dar. Obwohl persönliche Daten im digitalen Zeitalter einen bedeutenden wirtschaftlichen Wert darstellen, erfolgt deren Preisgabe häufig beiläufig und unbewusst. In mobilen Ökosystemen ist die Entscheidung für eine mobile Applikation oft direkt verknüpft mit der Preisgabe von persönlichen Daten. Diese Entscheidungssituationen unterliegen zu einem großen Maße Unsicherheiten, Ungewissheiten und asymmetrischer Informationen – trotzdem beziehen Nutzer massenhaft mobile Applikationen und digitale Services. Scheinbar paradoxes Verhalten wie dieses wird in der Sozialpsychologie und der Verhaltensökonomie oft dadurch erklärt, dass die Entscheidungen von niedrigen kognitiven Anstrengungen geprägt sind und sich durch äußere Einflüsse manipulieren lassen. Derartige Effekte wurden im Rahmen einer experimentellen Serie durch die Anwendung unterschiedlicher Stimuli untersucht. Die Ergebnisse stützen die Sichtweise, dass Nutzer in digitalen Systemen bzgl. der Preisgabe ihrer persönlichen Daten mit nur niedriger kognitiver Anstrengung entscheiden. Diese Erkenntnisse führen zu möglichen Implikationen für App-Entwickler, den Verbraucherschutz sowie zukünftige Forschungsarbeiten im Rahmen der Datenfreigabe und des Datenschutzes. Due to the profound integration of information systems, e. g. by smartphones and tablets, into the private and professional daily routines, information privacy of users is a highly relevant topic for research and practice. Even though personal data represents an important economic value in the digital age, the disclosure of personal information is often incidental and unconscious. The decision-making for an app in mobile ecosystems is often connected with the disclosure of personal information. Such decision-making situations underlie uncertainties, ambiguities and asymmetric information to a high degree—nevertheless users are obtaining vast numbers of mobile applications and digital services. This seemingly paradoxically behavior is according to research in social psychology and behavioral economics due to the facts that decision-making is dominated by low cognitive effort and can be manipulated by extraneous influences. Such effects have been investigated within the scope of an experiment series using different stimuli. The results support the view that users in digital systems make their decisions regarding the disclosure of personal information with low cognitive effort. Those findings have implications for app developers, consumer protection as well as further research activities in the field of data disclosure and data protection.
- KonferenzbeitragMy Data is Mine - Users' Handling of Personal Data in Everyday Life(SICHERHEIT 2018, 2018) Bock, SvenAbstract: This experimental study is about investigating users’ handling of personal data and their awareness of data collection. A deception experiment was designed to let the subjects believe that they are participating in a decision-making experiment. Only after the experiment, they were informed about the actual aim of examining their behaviour towards their personal data. Before the deception experiment either a printed or a digital version of the terms and conditions was handed out. The reading time and the willingness to accept the terms and conditions was measured in order to find significant differences. For the deception, a program was implemented which simultaneously presents two terms including sensitive data like religious and political orientation. The subject should choose the favoured term. Afterwards, subjects were asked whether and to what extent they agree to hand out their collected data to third parties in exchange for financial gain. After the experiment the participants were asked about their usual behaviour regarding their personal data.

Compared to the material world, data traces will to an increasing degree be used for the purpose of personalisation in the e-world. The article examines both the risks for the self-determination of the data subject and the safeguards of data protection law in this world. It is apparent that the requirements of data protection law are frequently not observed. However, the law is able to form the legal basis of necessary personalisations and to protect the data subject if this process is carried out without his/her consent. It is important to distinguish these single processes from the accumulating effects of ubiquitous electronic personalisation. The latter form fundamental problems for democratic societies, and data protection laws do not have the ability to solve these issues. In contrast, there is a strong need for the separation between personalisation and control on a technical level.

This paper reflects on this challenge and proposes a way for the privacy-friendly sharing of data.
