Ausschlaggebend ist, wer die Entscheidungsbefugnis hinsichtlich Zweck und Mittel der Verarbeitung innehat. Die Identifikation der faktischen Verantwortung und die Operationalisierung auf handelnde Menschen gestalten sich insbesondere dann schwierig, wenn in Konzernen oder Unternehmensgruppen zentrale Funktionen personenbezogene Daten verarbeiten, wie etwa eine zentrale IT- oder Personalabteilung. Welcher Konzernteil für die Umsetzung der über 30 bußgeld-bewehrten Verpflichtungen der DSGVO verantwortlich ist, ergibt sich keinesfalls von selbst. Anhand einer beispielhaften Konzernstruktur entwickelt dieser Beitrag eine Methodik, um für eine zentralisierte Verarbeitung von Mitarbeiterdaten die faktische Verantwortung mehrerer Verantwortlicher für ein und dieselbe Verarbeitung zu identifizieren und anwendbar zu machen.AbstractAccording to the new EU GDPR, there may be one or more controller for the compliant processing of personal data. The decisive factor is who holds the decision-making power with regard to the purpose and means of processing. The identification of the factual responsibility and the operationalization on acting people are particularly difficult when within groups central functions of the group process personal data, such as a central IT or personnel department. Which part of the company is responsible for the implementation of the more than 30 fined obligations of the GDPR is not by itself self-evident. Based on an exemplary group structure, this article develops a methodology to identify the factual responsibility of more than one controller for a centralized processing of employee data. The methodology shows how the joint controllers can be identified and how it is applicable.

Unfortunately, there is an increasing number of examples where AI systems show problematic behavior, such as discrimination or insufficient accuracy, missing data privacy or transparency. To counteract this trend, an EU initiative has drafted a legal framework and recommendations on how AI can be more trustworthy and comply with people's fundamental rights. However, fundamental rights are currently not reflected in procedure models for the development and operation of AI systems. Our work contributes to closing this gap so that companies, especially SMEs with small IT departments and limited financial resources, are supported in the development process. Within the framework of a structured literature review, we derive a procedure model for the development and operation of AI systems and subsequently integrate concrete recommendations for achieving trustworthiness.

Sie wird auf Basis des Drei-Säulen-Modells (Ökonomie, Ökologie, Soziales) operationalisiert und soll die Lebensgrundlage aktueller und zukünftiger Generationen sichern. Durch strengere gesetzliche Anforderungen, wachsenden Wettbewerbsdruck und die zunehmend von Nachhaltigkeitskriterien getriebenen Entscheidungen externer Interessengruppen sehen sich Unternehmen weltweit der zentralen Herausforderung gegenüber, Gewinnerzielung und Nachhaltigkeitskriterien in Einklang zu bringen. Eine wesentliche Grundlage hierfür bietet das datenbasierte betriebliche Nachhaltigkeitsmanagement. Das in diesem Beitrag vorgestellte Reifegradmodell synthetisiert und erweitert den aktuellen Stand der Forschung auf Basis einer Literaturrecherche. Es analysiert die organisationale Verwendung von Rahmenwerken, Kennzahlen und Steuerungswerkzeugen sowie die Reife des Nachhaltigkeitsdatenmanagements und die zu seiner Umsetzung verwendete IT-Architektur. Das Reifegrad- und das Vorgehensmodell sollen auch mittelständischen Unternehmen ein Instrumentarium bieten, um eine pragmatische Einschätzung des Status quo sowie des Entwicklungspotentials des eigenen Nachhaltigkeitsmanagements vorzunehmen. In the course of the last four decades, sustainability has also become a central concept in business information systems engineering, thanks to a variety of national and international initiatives. It is operationalised on the basis of the three-pillar-model (social, ecological and economic issues) and aims to secure the basis of life for current and future generations. As a result of stricter legal requirements, growing competitive pressure and increasingly sustainability-driven decisions by external stakeholders, companies around the world are facing the central challenge of reconciling profit generation and sustainability criteria. Herefore, data-based corporate sustainability management provides a key foundation. The maturity model presented in this article synthesises and expands the current state of research based on a literature review. It analyses the organisational use of frameworks, key performance indicators and management tools as well as the maturity of a company’s sustainability data management and the IT architecture used for its implementation. The maturity as well as the procedure model are intended to also provide medium-sized companies with a set of instruments for a pragmatic assessment of the status quo and the development potential of their own sustainability management.
